Red Light Tickets
Red light tickets are issued based upon a computer-controlled photograph or video taken of the vehicle and its driver. Based on the video or photo evidence, the city/county issues a citation to the registered owner of a vehicle that crosses the first limit line after the light has turned red.
More and more counties are adding red light cameras.
Why?
Because they are an excellent source of revenue. While they claim to improve public safety, the evidence is dubious. When most people receive red light tickets, they assume there is nothing they can do. How are you supposed to argue with a photograph or video?
However, in actuality, red light tickets are vulnerable to attack from a number of angles. For example, under the confrontation clause, you have a right to confront witnesses against you. But who is the witness against you when the only evidence is a photograph? This paradox creates a difficult legal scenario for the prosecution. Beahm Law has had success getting red light tickets dismissed prior to trial as well as winning at trial.
